Draft new IGPG on Gambling Guidance – open for feedback

Consultation is now open on our new draft Inspector-General Practice Guide (IGPG) on personal insolvency and gambling.

We are seeking feedback to ensure the draft IGPG provides relevant guidance and support on our processes for dealing with gambling-related bankruptcies.

Background

This consultation follows the March 2023 Personal Insolvency Roundtable hosted by the Attorney-General of Australia, where feedback was received from financial counsellors on the impacts of s271 of the Bankruptcy Act 1966 on their clients.

The goal

The draft IGPG aims to balance vulnerability and gambling disorder with any assessment of a gambling offence such as cases where there is clear evidence of a gambling disorder and no associated criminal activity to aid gambling has occurred.

This IGPG will assist practitioners to understand their obligations in referring matters that appear to contradict this advice, and financial counsellors when advising their clients.
