AFSA is an executive agency of the Attorney General’s Department. We contribute to Australia’s economic and social prosperity by administering and regulating the personal insolvency and personal property securities systems and managing criminal assets.

 We are a small, ambitious and dynamic agency. With staff based across the country, we play a critical role in Australia’s $3.5 trillion credit system. We do so by administrating and regulating the personal property securities register as well as personal insolvencies. We also work with other agencies to manage criminal assets and we have almost $400 billion in assets under management. Our staff work with a wide range of stakeholders to provide empathetic and high-quality services.

Regulatory Operations Group

The Regulatory Operations Group (ROG) is responsible for the way AFSA regulates including our approach to compliance, enforcement and education. ROG plays a pivotal role in supporting clients navigating AFSA’s systems while ensuring strict compliance with regulatory standards.

Education, Surveillance & Enforcement Division

The Education, Surveillance & Enforcement division promotes compliance with our financial regulations and ensures the integrity of the systems we regulate. This division is responsible for:

  • Education: developing and implementing educational initiatives to enhance public understanding of our laws and regulations. These efforts empower individuals and businesses to make informed decisions and comply with their legal requirements.
  • Surveillance: Through monitoring and surveillance activities, the division identifies potential risks, misconduct or non-compliance
  • Enforcement: we take swift action against those who misuse our systems. This work could include conducting investigations, audits and inspections, as well as imposing penalties, sanctions or legal action against offenders.
Regulatory Services Division

Regulatory Services promotes compliance, professionalism and integrity within the bankruptcy and personal insolvency systems and also manages criminal assets. The division manages the personal property securities register, improves practitioner standards, administers insolvent estates, and provides customer support.

Teams include:

  • Criminal Asset Management (CAM): manages assets seized or restrained as part of criminal investigations matters. This team works closely with the AFP and other stakeholders.
  • Personal Property Securities (PPS): oversees the Personal Property Securities Register (PPSR), a national online register that allows individuals and business to register security interests in personal property.
  • Practice Quality & Improvement (PQ&I): improves the quality and standards of practice among insolvency practitioners and trustees. They support in the development of training programs, guidelines and resources. They also conduct reviews, assessments and audits to monitor and evaluate compliance.
  • Estate Administration: administers bankrupt estates and manages the distribution of assets to.
  • AFSA Service Centre: serves as a central point of contact for clients, individuals, and businesses seeking information or assistance, related to personal insolvency and personal property securities.
Official Receiver Division

The Official Receiver Division oversees AFSA’s Official Receiver functions and exercises the powers of the Official Receiver under the Bankruptcy Act 1966 and has responsibility for maintaining the National Personal Insolvency Register (NPII) under the Bankruptcy Regulations 2021. The Official Receiver also oversees the fair and efficient administration of bankrupt estates.

Enabling Services Group

The Enabling Services Group supports AFSA’s core regulatory functions.

The group shapes AFSA’s strategic direction, manages government relationships, provides effective corporate services, and leverages AFSA’s technology to promote organisational delivery and performance.

Corporate Services Division

The Corporate Services division includes teams that oversee workforce planning and reporting, capability and talent development, payroll administration, financial management, security and property, as well as drivers of safety and wellbeing initiatives.

Operating across the agency, they provide comprehensive services and solutions that are effective and efficient.

Strategy & Government Division

The Strategy & Government Division leads strategic planning and delivery. They also leads the agency’s strategic communications, stakeholder engagement and government relations functions.

Technology Services & Service Modernisation Division

The Technology Services & Service Modernisation Division provides core business and enterprise applications, cyber security and compliance technology operations and support, data, and service design and transition. 

Legal and Strategic Analytics

As well as our two Groups of Regulatory Operations and Enabling Services, we have Legal and Strategic Analytics teams which report directly to the Chief Executive.
